1. About These Terms
These Terms of Service govern purchases made at Middletown Home Outlet, located at 701 Route 211 E, Middletown, NY 10941 (“we,” “us,” “Middletown Home Outlet”), and your use of this website (middletownhomeoutlet.com). By shopping with us or using this site, you agree to these Terms.
2. Outlet, Closeout & “As-Is” Inventory
Our inventory consists primarily of brand-new furniture, manufacturer overstock, floor models and Home Depot return product. Items may be sealed-box, open-box or have minor cosmetic wear. Each tag describes the item's condition to the best of our ability. All sales are final and sold “as is” unless the tag states otherwise. Please inspect items before loading.
3. Pricing
Tagged prices reflect the outlet price. We reserve the right to correct pricing errors. Sales tax is added at checkout where applicable, unless a valid resale or tax-exempt certificate is on file. Pricing on this website is informational and may not reflect a binding offer for any specific item — confirm by phone or in-store.
4. Stock & Availability
Floor inventory rotates with truckload arrivals and turns over quickly. Items shown on this website are illustrative — we do not maintain a live online inventory. Call (845) 209-9999 to confirm whether a specific category or item is currently on the floor.
5. Holds, Payment & Pickup
- Holds: Paid items may be held for a short window so you can arrange a vehicle or hauler.
- Payment: Major credit cards, debit cards and cash. Wholesale-load payment terms are confirmed by phone.
- Pickup: Pickup-first warehouse. We provide loading assistance and forklift service for large items. Buyer is responsible for transport.
6. Returns & Refunds
Because inventory is closeout, most sales are final once you have loaded out of the warehouse. We will work in good faith to address undisclosed defects on a case-by-case basis. Refunds, when granted, are issued to the original payment method. Items must be returned in the same condition they were sold in.
7. Warranty Disclosure
We do not provide a store warranty. Manufacturer warranties on Home Depot return appliances, tools and other products are not guaranteed by us — coverage depends on the manufacturer's policy, serial number and registration. Where a manufacturer warranty applies, your remedy is with the manufacturer.
TO THE FULLEST EXTENT PERMITTED BY LAW, PRODUCTS ARE SOLD “AS IS” AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Wholesale Loads
Pallet, bunk and truckload purchases are sold by mixed-category load as described at the time of pickup. Contents are inspected at our warehouse before pickup; once the load leaves the lot, the sale is final.
9. Use of This Website
Photos and descriptions on this website are for illustration only and may show floor-rotation product no longer in stock. Do not rely on this website as a real-time inventory or pricing source.
10. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim related to a product or this website is limited to the purchase price you paid for the item. We are not liable for indirect, incidental or consequential damages.
11. Governing Law
These Terms are governed by the laws of the State of New York. Any dispute will be resolved as described in the Dispute Resolution section below.
Dispute Resolution; Binding Arbitration; Class Action & Jury Trial Waiver
Informal Resolution
Before initiating any claim, you agree to first contact us and attempt to resolve the dispute informally. Most concerns can be resolved this way.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, this website, or our services that cannot be resolved informally shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The arbitration shall take place in the county and state in which the Company's principal place of business is located, unless applicable law requires otherwise.
Class Action & Jury Trial Waiver
You and the Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and the Company waive any right to a jury trial and any right to participate in a class action or class-wide arbitration.
If any portion of this section is held unenforceable, the remainder of this section shall remain in effect; however, the prohibition on class, collective, or representative proceedings is non-severable.
